In this article I examine some of the issues involved in taking psychiatric disorders as natural kinds. I begin by introducing a permissive model of natural kind-hood that at least prima facie seems to allow psychiatric disorders to be natural kinds. The model, however, hinges on there in principle being some grounding that is shared by all members of a kind, which explain all or most of the additional shared projectible properties. This leads us to the following question: what grounding (...) do psychiatric disorders qua natural kinds have? My principal method for examining the issue is a case study of a particular psychiatric disorder: the so-called “apathetic children.” I argue that there appear to be at least two competing models that both appeal to non-organic a grounding of the disorder. However, for other psychiatric disorders, such as Alzheimer’s disease, the evidence points toward an organic explanation of the disorder. I contend that what unites psychiatric disorders is not a distinctive type of grounding that all psychiatric disorders share, but the distinctive set of determinable properties that is shared by all psychiatric disorders. Natural kinds is a widely used and pivotal concept in philosophy – the idea being that the classifications and taxonomies employed by science correspond to the real kinds in nature. Natural kinds are often opposed to the idea of kinds in the human and social sciences, which are typically seen as social constructions, characterised by changing norms and resisting scientific reduction. Yet human beings are also a subject of scientific study.Does this mean humans fall into corresponding kinds of their own? (...) In The Epistemology and Morality of Human Kinds Marion Godman defends the idea of human kinds. She first examines the scientific use and nature of human kinds, considering the arguments of key philosophers whose work bears upon human kinds, such as Ian Hacking, John Searle, Richard Boyd and Ruth Millikan. Using the examples of gender, ethnic minorities and Buddhism she then argues that human kinds are a result of ongoing historical reproduction, chiefly due to pre-existing cultural models and social learning. Her novel argument shifts the focus away from the reductionism characteristic of research about human kinds. Instead, she argues that they are “multiply projectable” and deserving of scientific study not in spite of, but because of their role in explaining our identity, injustice and the emergence of group rights. Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

The objective of this paper is to understand from a sociological perspective how the moral question of euthanasia, framed as the “right to die”, emerges and is dealt with in society. It takes France and Germany as case studies, two countries in which euthanasia is prohibited and which have similar legislation on the issue. I presuppose that, and explore how, each society has its own specificities in terms of practical, social and political norms that affect the ways in which they (...) deal with these issues. The paper thus seeks to understand how requests for the “right to die” emerge in each society, through both the debate (analysis of daily newspapers, medical and philosophical literature, legal texts) and the practices (ethnographic work in three French and two German hospitals) that elucidate the phenomenon. It does so, however, without attempting to solve the moral question of euthanasia. In spite of the differences observed between these two countries, the central issue at stake in their respective debates is the question of the individual’s autonomy to choose the conditions in which he or she wishes to die; these conditions depend, amongst others, on the doctor-patient relationship, the organisation of end-of-life care in hospital settings, and more generally, on the way autonomy is defined and handled in the public debate. We hear a lot about bubbles and echo chambers these days. People talk only to others who have similar ideas to themselves. Supporters of political parties, believers in conspiracy theories (such as QAnon), members of many other groups continually talk to fellow believers, and seldom seriously consider what outsiders say. However, we need to acknowledge that we ourselves also exist within bubbles. While perhaps not in the same league as the examples above, philosophy for/with children (P4/wC) advocates and researchers can (...) also fall into the trap of listening only to others within our field. In many ways, this is understandable. Over more than 50 years, the P4/wC literature has ballooned, and it is unlikely that any one person has had the time to be able to read it all, let alone chasing down other literature. Yet we are not the only people who are interested in classroom discussions. For example, when I was doing my PhD, I read a fascinating and informative book by JT Dillon—Using Discussion in Classrooms—which I have never seen referenced in the P4/wC literature. The book under review here is another example. Published in the Ed Psych Insights series by Routledge, it is edited by P Karen Murphy, the Harry and Marion Royer Eberly Faculty Fellow and Professor of Education at The Pennsylvania State University. Of the eight other contributors to this book, seven are doctoral students, and one a post-doc, at either The Pennsylvania State University or the University of North Carolina at Chapel Hill. This is quite a tight little bubble: the Quality Talk bubble. Quality Talk (QT) is the name of the approach to classroom discussions devised by Murphy and her collaborators. (shrink)

While reviewing relevant recent research, it becomes apparent that cognitive approaches have been rejected and excluded from Critical Discourse Analysis by many scholars out of often unjustified reasons. This article argues, in contrast, that studies in CDA would gain significantly through integrating insights from socio-cognitive theories into their framework. Examples from my own research into the comprehension and comprehensibility of news broadcasts, Internet discussion boards as well as into discourse and discrimination illustrate this position. However, I also argue that there (...) are salient limits to cognitive theories which have to be taken into account, specifically when proposing social change via rational/cognitive insights. Examples from recent political debates on immigration and from the election campaign in the US in 2004 serve to emphasize these arguments. (shrink)

Pervasive though it is in modern life, the concept of self‐esteem is often viewed with distrust. This paper departs from an idea that was recently aired by Richard Smith: that we might be better off without this concept. The meaning of self‐esteem is explored within four ‘homes’: the self‐help industry, social science, therapy and education. It is suggested that the first two use a ‘simple’ concept of self‐esteem that indeed we are better off without. This concept eliminates the distinction between (...) truthfulness and delusion, and relies on a chimera of quantifiability. The much richer concept of situated self‐esteem is explored, and it is argued that low self‐esteem in children should command the attention of educators. Teachers should address this through education and communication, and reject the idea of boosting self‐esteem through a content‐free curriculum. (shrink)

This editorial explains the themes of the forthcoming FLaK seminar and how those themes draw on the collective and individual contributions of the articles, interviews and commentaries presented in this issue. At FLaK, we propose to think with others about the kind of ‘kitchen table’ that FLS might provide into the future. How might feminist legal studies—the approach and the journal—best use its food, equipment, techniques, time, space, mood, energy and commitment? How shall FLS scholars and associates make the most (...) of what we have in a room that can sometimes be confining and confusing, yet also exciting and sustaining? How do others engage with the processes and products of our kitchen table? In considering these issues and more, we propose to draw reflexively on feminist legacies of praxis, internationalism and openness, as we stock up and critically reflect on decolonizing techniques, legal know-how, protest and publishing practices. Descartes forge alors un nouvel argument sceptique : le « Dieu qui peut tout », qui permet de penser que, lorsque je me rends à l’évidence des natures simples, (...) je peux me tromper du point de vue d’une autre rationalité et d’une évidence supérieure à la mienne. Mais le doute n’est pas seulement chez Descartes un moment et un moyen provisoires qu’il s’agirait de vaincre, et qui serait effectivement vaincu par la certitude du cogito. Puisqu’il ne dévoile aucune chose, n’énonce aucune proposition et n’engage pas la moindre prédication, le doute laisse en effet la parole ne dire qu’elle-même et se manifester ce qui y parle, c’est-à-dire celui qui parle, ego. Tim Maudlin's argument for the inconsistency of Cramer's Transactional Interpretation of quantum theory has been considered in some detail by Joseph Berkovitz, who has provided a possible solution to this challenge at the cost of a significant empirical lacuna on the part of TI. The present paper proposes an alternative solution in which Maudlin's charge of inconsistency is evaded but at no cost of empirical content on the part of TI. However, Maudlin's argument is taken as ruling out Cramer's heuristic (...) "pseudotime" explanation of the realization of one transaction out of many. (shrink)

Like the National Commission and the President's Commission, the Advisory Committee on Human Radiation Experiments was formed to carry out specific ethical tasks. Yet the committee also had an “openness” mission, a charge to investigate allegations that the U.S. government secretly exposed Americans to environmental releases of radiation. Eighteen months later—and after sixteen public meetings, more than 200 interviews, and the review of about 400,000 documents—the committee delivered a 925‐page report to the president.

Commercial video games are popular entertainment media and part of students’ media reality. While commercial video games’ main purpose is not learning, they nonetheless could and should serve as objects of reflection in formal educational settings. Teachers could guide student learning and reflection as well as motivate students with commercial video games, but more evidence from formal educational settings is required. We conducted two mixed methods case studies to investigate students’ reflection processes using commercial video games in regular formal high (...) school teaching. In a double lesson, 29 students of a 10th-grade biology course and 17 students of a 12th-grade advanced course on history played and discussed a commercial video game related to the current curricular topic. We examined the reflection processes of students in terms of their reactions to the teachers’ game-related statements and questions. Regarding teachers’ statements, students discussed several topics related to game enjoyment and the games’ representation of topic-related content. Regarding teachers’ questions, students discussed multiple goals in each game, how the games represented topic-related content, and how the games could be appropriate for learning. In Study 2, students additionally discussed emotions, stereotypes, violence, and the narrative related to the digital history game. We found that the discussions provided students opportunities to reflect on their game experiences and the current curricular topic as well as to practice media criticism. We further provide quantitative results on students’ perceived topic knowledge, on several facets of their learning motivation, and on their acceptance of video games. Overall, our findings illustrate the educational value of using commercial video games as objects of reflection. (shrink)

Pour Descartes comme pour Spinoza la finitude de notre entendement rend impossible l'adéquation de la connaissance. À la connaissance adéquate, Descartes substitue la connaissance complète : certaine, mais non-absolue, vérifiée, mais seulement provisoire. La mise au (...) jour de cette première origine cartésienne de la théorie spinoziste de l'idée adéquate conduit l'auteur à l'hypothèse suivante : cette théorie accomplirait au sein de la métaphysique rationnelle développée dans l'Éthique la doctrine de la révélation et de la grâce présente dans la pensée théologique chrétienne. Dès lors il met en évidence la correspondance entre la vision béatifique suarézienne et la connaissance adéquate spinozienne, la première anticipant historiquement la seconde, à cette différence près que pour Thomas d'Aquin comme pour Suarez, « c'est la vision béatifique qui commande la connaissance », alors que c'est l'inverse pour Spinoza. Since the last issue of Feminist Legal Studies, we editorial board members have had lots of conversations about comfort, displacement and alienation. As we developed the programme for #FLaK2016 we thought about it as a kind of pulling ourselves out of our comfort zone, if academic events and journals ever have a comfort zone. Drawing on a mix of feminist live performance methods and a science and technology studies-type curiosity for objects of experimentation, we tried out a kitchen table method (...) of hosting a live research conversation with activists, artists and academics over two days. But we had not fully anticipated the way that the Brexit result would contribute to and complicate discomfort. A fuller analysis of FLaK awaits a later moment, but here we pick out this one aspect of our gathering—feelings of discomfort – as they animate the contributions to this issue in interesting ways. Most of Christine Swanton’s quotations from and references to Nietzsche are drawn The Genealogy of Morals, Thus Spoke Zarathustra, and Beyond Good and Evil. I suggest that Human, All too Human and Daybreak, two of Nietzsche’s most neglected works, provide rich resources for Swanton’s interpretation of Nietzsche’s view of self-love and its defining role in genuinely ethical action. Self-love assumes a central place in these writings, as do its cognate concepts of egoism and vanity. I outline some of the reasons (...) why these two middle period writings recommend themselves powerfully for Swanton’s philosophical purposes. I examine to what extent passages on self-love from these neglected works nourish, but also to what extent they challenge or upset, the central place accorded to self-love in Swanton’s recalibration of virtue ethics. As research into identity in the information society gets into its stride, with contributions from many scholarly disciplines such as technology, social sciences, the humanities and the law, a moment of intellectual stocktaking seems appropriate. This article seeks to provide a roadmap of research currently undertaken in the field of identity and identity management showing how the area is developing and how disparate contributions relate to each other. Five different perspectives are proposed through which work in the identity field can (...) be seen: tensions, themes, application areas, research focus and disciplinary approaches and taken together they provide a comprehensive overview of the intellectual territory currently being tilled by academia on this subject. This attempt at a coherent overview is offered in the spirit of debate and discussion, and the authors invite criticism, development and improvement. Another purpose of this paper is to provide an introduction to the range and type of research that the new journal Identity in the Information Society will publish, giving researchers working in the field a clearer idea of the scope of multidisciplinary study that is envisaged. The volume discusses the problem of Freedom from diverse points of view and offers a synthesis of issues and conclusions relating to freedom as a basis for action with a view to try and fill the gaps existent in the study of the nature of Man.

It is shown that violation of the Born Rule leads to a breakdown of the correspondence between the quantum electromagnetic field and its classical counterpart. Specifically, the relationship of the quantum coherent state to the classical electromagnetic field turns out to imply that if the Born Rule were violated, this could result in apparent deviations from the energy conservation law applying to the field and its sources. The result, which is fully general and independent of interpretations of quantum theory, suggests (...) that the Born Rule is just as fundamental a law of Nature as are the field conservation laws.
